are banned in the USA, but they are, the eggs are made from hollow milk chocolate that contain a toy inside, the surprise, as you do not know what the toy will be, and that is the problem whilst the eggs are popular around the world, in Europe, South America and even Canada with children and collectors buying them it appears that they are not safe in the USA, many of the toys that have been tested by the Consumer Product Safety Commission in the past were determined to present a choking hazard for young children and has been determined that this product fails to meet small parts requirements for children less than three years of age, so when travelling to America, do not what ever you do buy a Kinder Surprise egg, or you will be charged with the illegal importation of Kinder Eggs, for more information on import alert 34-02, please visit the FDA website, it seems strange that kids in other countries are not dying by the tens of thousands on Kinder egg toys, especially when you think that three-and-half billion Kinder eggs are sold globally each year! 

and now the good news, in 2018, Ferrero International will release the “Kinder Joy” in America, unlike the Kinder Surprise it has two distinct, sealed halves, one half contains the mystery toy, and the other half is filled with chocolate, milk-crème, and chocolate wafer bites, this tweak of having the toy and chocolate packaged in separate sections makes this version of the Kinder egg adhere to the FDA regulation, just hope the kids in America do not get hold of the wrong section!
